Phase 1 – Availability & Jurisdiction Notice

1. Purpose of this page

Elite64 is an online platform offering skill-based chess competitions. This page explains where the service is intended to be available during Phase 1, and clarifies the limits of availability based on applicable laws and regulations.

Elite64 operates skill-based chess competitions. Participation requires skill, knowledge, and performance in chess.

2. Phase 1 availability

United Kingdom (Great Britain)

Service intended to be available

During Phase 1, Elite64 is intended for users located in the United Kingdom.

Legal rationale (high-level):

Under UK law, regulation focuses on activities involving chance. Skill-based competitions, where outcomes are determined predominantly by participant skill rather than chance, are generally treated outside the scope of regulated activities, while allowing limited operational randomisation for administration and fairness.

Elite64 competitions: are based primarily on chess skill; may include limited operational randomisation (such as colour assignment or bye allocation) for tournament administration and fairness; use fixed and pre-announced reward pools; do not provide any guarantee of gain.

Elite64 is operated by a UK company and governed by the laws of England & Wales. This jurisdiction provides the clearest legal framework for launching Phase 1 of the platform.

Reference: UK legislation — distinction between games of chance and competitions of skill.

3. Other countries and territories

Availability outside the United Kingdom

Not available in Phase 1

Outside the United Kingdom, Elite64 is not currently intended to be available during Phase 1.

Legal treatment of paid competitions, reward pools, and online skill-based games varies significantly between jurisdictions and may involve: licensing requirements; specific authorisations; consumer protection obligations; or classification as regulated gaming activities.

Elite64 does not actively offer or market its services in these jurisdictions during Phase 1.

No representation is made that the service is lawful or authorised in any jurisdiction outside the United Kingdom at this stage.

4. Prohibited or restricted jurisdictions

Void where prohibited

Elite64 is not available in jurisdictions where: paid competitions with reward pools are prohibited; such activities require a licence or authorisation not held by the operator; or where applicable law otherwise restricts access to the service.

If local law prohibits access, participation is void.

5. User responsibility

By accessing or using the Elite64 platform, you confirm that: you are legally permitted to access the service in your place of residence; participation in skill-based competitions is lawful under applicable local laws; you understand that availability may be restricted or withdrawn at any time.

Elite64 does not provide legal advice regarding local laws. Users are responsible for ensuring compliance with their applicable regulations.

6. No guarantee of future availability

The availability of Elite64 in any jurisdiction: may change at any time; does not create any right or expectation of continued access; does not constitute a commitment to expand into additional countries.

Any future expansion will be subject to legal, regulatory, technical, and operational review.
